Welcome to Couture!

1.  Introduction:

Couture, also referred to as Couture Portal LLC or www.Couture.com, is an online classified advertising platform that connects buyers and sellers. The platform allows sellers to list their products or services while buyers are able to search or browse the advertisements and contact the sellers either through the platform or via seller contact details.

2.  Definitions:

In this Terms of Use Agreement, the following words, and expressions, for the purpose of this agreement, bear the meaning hereby assigned to them:

Couture: Couture Platform LLC, also known as www.Couture.com

Platform(s): the mobiles apps and website or any other online property that we use to offer various Product(s) and Service(s)

Product(s) and Service(s): any product, service, tool, function, technology, or content that we offer to the users 

User posted Material: any content posted by the user. This includes, and is not limited to, descriptions, explanations, details, and images

3.  Term of Use Agreement

Terms of Use Agreement is made between Couture (“we”, “us”, “our”, “the Company”) and you (“you”, “your” or the “User”). 

By using Couture mobile applications or www.Couture.com, you confirm that you have read, understood and accepted the Terms of Use and agree to comply with them. By accepting the Terms of Use, we, Couture, agree to permit you and allow you to use the platforms. If you don’t accept and agree to these Terms of Use or part of it, you must refrain immediately from using the platform(s). These terms may be updated or changed from time to time at our sole discretion. Any updates to the terms of use will be forwarded to the registered email of every user and users are obliged to comply with them effectively from the date of receipt of the notification. Updates will be also published on the platform and it’s the user’s sole responsibility to review, understand and comply with the same.

IF ANY OF THE CHANGES OR UPDATES WITH REGARD TO THE TERMS OF USE ARE NOT ACCEPTABLE TO YOU, YOU MUST DISCONTINUE USING THE PLATFORM IMMEDIATELY. IF YOU CONTINUE TO USE THE PLATFORM AFTER ANY CHANGES OR UPDATES, THIS WILL INDICATE THAT YOU AGREE TO AND ACCEPT THE NEW CHANGES OR UPDATES UNCONDITIONALLY. Couture may provide translated versions of the Terms of Use in other languages; however, the English version will supersede any other versions.

 

Below are the Terms of Use:

 

  1. The user hereby acknowledges that he/she is at least 18 years old and legally able to enter into this agreement.                                                                                                                                                                                                       
  2. While registering on the Couture platforms, the user must provide factually correct information/details. These details must be current and accurate. In case these details change, the user must update his/her registration details accordingly.                                                                                                                                                                                                                                         
  3. The user hereby agrees and acknowledges that the platforms will contain products and services that are advertised/posted by other users or companies and Couture will not be responsible for the veracity or trustworthiness of the ads. Couture will only connect the buyer with the seller and will not be legally responsible for the agreement or the deal that is made between the buyer and the seller. Couture will not be liable for any loss in any manner or circumstance. The buyer is totally at his/her own risk when dealing with the seller. He/she is advised to thoroughly check and verify the accuracy or factual correctness of the product(s) advertised.                                                                                                                                                                                                                                                                                       
  4. Couture approves ads for publishing based on several legal and ethical criteria. Couture has the full right to modify the user-posted material (if it contains illegal, factually incorrect, misleading or socially unacceptable text/image content). Couture reserves the right to delete or refuse to post any user material without consultation with, or approval from, the user and without any prior notice, if the advertisement goes against the law and social/ethical customs and principles. Further, Couture holds the right to change any advertisement’s category/subcategory in accordance with its categorization scheme, without any prior notice.                                                                                                                                                                                                
  5. Couture reserves the right to block or suspend any user from using the platform and also to delete any user’s account if the user is found to have breached any of the Terms of Use agreement. In the event of a blockage, suspension, or termination, Couture will send a notification to the user via the registered email. The user is not allowed to re-register on the platform directly or indirectly.                                                                                                                                                                                                                                                                            

  6. The user registration details will be stored in the Couture server and will not be disclosed to any 3rd party (other than what is stated in the privacy policy) unless it’s requested by law/court or government agencies. These registration details will not be used for any purposes other than to allow user(s) smooth access to the platforms and provide better user experience. In the case of special offers (such as price discounts, special launch price, buy-and-get-free offers etc.) by Couture or any other 3rd party for marketing purposes, the user authorizes Couture to communicate the offer details to him/her. In the case of marketing emails, the user will be able to unsubscribe if he/she wishes not to receive the same.                                                                                                                                                   

  7. The user must not share his/her user account details with anyone, as part of Couture’s security process.

  8. Couture requests all users to report any fraud or suspicion of any fraud. Users can report fraudulent activity/post/offer or suspicion of fraud using the fraud/scam reporting features provided by Couture to every user. Alternatively, users can directly report these matters by sending an email to legal@Couture.com. Couture will not be liable for any such fraud/misleading advertisements or related issues. Users are encouraged to send their comments on seller’s misleading posts as well as other users’ suspicious activities and lack of integrity and ethics. 

  9. The user must not upload or post any material that is illegal, offensive, racist, indecent, pornographic, insulting, threatening, harmful/potentially harmful to minors, deceptive, and/or related to money laundering and gambling.

  10. The user must not breach any applicable law, standard regulations and legislation related to animals, alcohol, & weapons.

  11. The user must not upload any material that may damage Couture’s reputation.

  12. The user must not upload any material that can cause damage to the platform or slow down its functionality or limit the available features.

  13. The user must not use any automated tools that enable the use of the platform automatically or allow the user enter/upload multiple data/ posts/products automatically. The platform is designed for manual login/use by humans and not via any automated tools.                                                                                                                                                                                                                                                                                                     

  14. All types of posts/ads are free of charge and Couture reserves the right to change, update or create payment packages without prior notice. 

  15. Regarding any post(s) by individuals or seller companies, Couture is not liable for any consequential loss of business, profit, revenue, contract, opportunity, goodwill, cost saving or data, or any other indirect loss that may be attributed to any post/ad(s) by individual user(s) or seller firm(s).

  16. If the user buys any product or service that was advertised or posted on Couture platforms, Couture cannot be held liable for the product or service quality, quantity or any loss of money as a result of using the product or service.

  17. Couture will take all the necessary measures to enable the platforms accessible to users most of the time and will use the necessary technology and tools to keep the platform virus-free. Nevertheless, Couture cannot guarantee complete/24x7 accessibility, fool-proof security or procedural errors on the platforms. Couture will not be liable for any consequential loss thereof due to inaccessibility or due to security-related issues.

  18. The user must not post any material that harasses or intimidates any individual or group of individuals based on ethnicity, religion, gender, sexual orientation, age or race.

  19. The user must not post any information including contact details of any other individual without their full approval and acceptance.

  20. The user must not infringe any intellectual property rights of other parties or individuals. Couture is not responsible and not liable for any infringement of any copyright and/or any other intellectual property rights, as a result of materials posted through the Couture platform. If you are an owner of intellectual property rights and believe that any content or post on Couture infringes your intellectual property right, you need to submit a notification to Couture and request to delete the relevant material.

  21. The user must not post any material that falls under fraud/scam category including, but not limited to, Pyramid scheme, Ponzi scheme, chain emails, bait marketing and negative option marketing.                                                                                             

    ACCEPTANCE OF TERMS OF USE

     You hereby acknowledge that you have read the Terms of Use and agree to all the terms of use. By accessing and using the Couture platforms and services you agree to be bound by all the Terms of Use and privacy policy. If you do not agree to comply with the terms of use or part of it or the privacy policy* or part of it, you are not authorized to use the Couture platform
